The visa waiver program (VWP) allows visitors for business or pleasure from 39 countries to enter the U.S. without having to apply for a visa. The period of admission is 90 days and cannot be extended. In addition, a visa waiver entrant cannot change to any other nonimmigrant visa classification. Instead, the individual must depart the U.S., apply for a visa abroad and then return. Individuals who have prior immigration violations will likely need to apply for a U.S. visa even if they come from a visa waiver country.
