The visa waiver program (VWP) allows visitors for business or pleasure from 39 countries to enter the U.S. without having to apply for a visa. The period of admission is 90 days and cannot be extended. In addition, a visa waiver entrant cannot change to any other nonimmigrant visa classification. Instead, the individual must depart the U.S., apply for a visa abroad and then return. Individuals who have prior immigration violations will likely need to apply for a U.S. visa even if they come from a visa waiver country. All visa waiver entrants must register with the Electronic System for Travel Authorization (ESTA) at least three days prior to departure. For more information on the visa waiver program and ESTA, please visit https://travel.state.gov/content/travel/en/us-visas/tourism-visit/visa-waiver-program.html.David Ware is proud to serve individuals and organizations nationwide.
