Is an employee’s H1-B visa going to expire?

Businesses and organizations sometimes use H1-B visas to bring specialty occupation workers to the United States. Perhaps the organization has identified someone with a certain set of skills or abilities, or with a specific degree, but this person is a foreign national. The organization can help them get a visa to come to the United States, where they will take a job that they have been offered.

But how long is that going to last? Is this a permanent solution for long-term employment? Or is the H1-B visa going to expire in the future?

It lasts for a total of six years

To start with, an H1-B visa is initially valid for three years. However, there are some extensions that workers can apply for. This could give them another three years, meaning that they have a maximum duration of six years on that visa.

This can change, depending on where the individual lives. For instance, perhaps the organization hired an employee who is going to be working both in the United States and in another country. If they spend an extended period of time—more than 12 months—outside of the United States, then they may be able to apply for another H1-B visa, resetting the clock. This could mean that they are eligible for another six years.

Naturally, some employees also choose to change their status. If an employee came to the organization on an H1-B visa and decided to stay in the position permanently, then they may decide to apply for a green card, and they may eventually even pursue citizenship.

Every situation is unique. But it is important for those involved in the immigration process to know exactly what legal options there are and what steps to take.
