June 2016 Visa Bulletin Shows Retrogressions

The U.S. Department of State has released the June 2016 Visa Bulletin, which yielded modest incremental progress for final action dates in most categories. However, China EB-2 retrogressed from September 1, 2012 to January 1, 2010; while China EB-3 retrogressed from August 15, 2013 to January 1, 2010. India EB-2 also saw a substantial retrogression from November 22, 2008 to October 1, 2004. In most cases with severe retrogressions, we see rapid forward progress at the beginning of the fiscal year, October 1, or perhaps before. We will keep you posted.

As of May 2016, U.S. Citizenship and Immigration Services is continuing to maintain its position that adjustment of status applicants at this time may only use the “Final Action Dates” chart and not the pre-registration “Dates for Filing” chart for both family and employment-based cases. It is not yet clear whether this trend will continue indefinitely, but we will keep you updated.

TPS Extension for Honduras and Nicaragua

The Department of Homeland Security (DHS), has extended Temporary Protected Status (TPS) for eligible nationals of Honduras and Nicaragua (and eligible individuals without nationality who last habitually resided in those countries) for an additional 18 months, through January 5, 2018. This announcement applies only those individuals who already have valid TPS.

Current TPS Honduras and Nicaragua beneficiaries seeking to extend their TPS must re-register during the 60-day re-registration period that runs from May 16, 2016 through July 15, 2016. U.S. Citizenship and Immigration Services (USCIS) encourages beneficiaries to re-register as soon as possible once the 60-day re-registration period begins. USCIS is now accepting applications.

The 18-month extension also allows TPS re-registrants to apply for a new Employment Authorization Document (EAD). Eligible TPS Honduras and Nicaragua beneficiaries who re-register during the 60-day period and request a new EAD will receive one with an expiration date of January 5, 2018.
